TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By accessing, using, or engaging with the services provided by Home Stimulus ("we," "us," "our," or "Company"), you ("you," "your," or "Client") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Home Stimulus.

If you do not agree to these Terms, you must immediately discontinue use of our services and refrain from engaging with Home Stimulus in any capacity.

By proceeding with any consultation, scheduling any appointment, or utilizing any guidance or strategy provided by Home Stimulus, you affirm your acceptance of these Terms in their entirety.

2. SERVICE DESCRIPTION

Home Stimulus provides savings-focused real estate strategies and incentive guidance designed to help clients optimize their financial outcomes in real estate transactions. Our services include, but are not limited to:

Buyer & Seller Savings Strategy: Consultation and strategic planning to identify potential savings opportunities for individuals buying or selling residential or commercial real estate.

Incentive & Credit Guidance: Information and guidance regarding available incentives, credits, tax benefits, and programs that may reduce costs or provide financial benefits in real estate transactions.

Cost Reduction Planning: Analysis and recommendations for reducing overall costs associated with real estate transactions, including but not limited to financing, closing costs, and transaction-related expenses.

Our services are educational and advisory in nature. Home Stimulus does not provide legal advice, tax preparation services, licensed financial planning, or real estate brokerage services. We do not represent, negotiate, or facilitate real estate transactions as a licensed real estate agent or broker.

The information and strategies provided are general in nature and may not be suitable for every individual circumstance. Clients are responsible for verifying the applicability and accuracy of any information provided and for consulting with appropriate licensed professionals including attorneys, accountants, tax advisors, and real estate agents before making financial or legal decisions.

3. USER OBLIGATIONS

By engaging with Home Stimulus, you agree to:

Provide accurate, complete, and current information when requested for the purpose of delivering our services effectively.

Use our services only for lawful purposes and in accordance with these Terms and all applicable local, state, and federal laws and regulations.

Not misrepresent your identity, affiliation, or the purpose for which you are seeking our services.

Maintain the confidentiality of any access credentials, account information, or proprietary materials provided to you by Home Stimulus.

Not reproduce, distribute, modify, or create derivative works from any proprietary content, materials, or strategies provided by Home Stimulus without express written permission.

Acknowledge that you are responsible for evaluating the suitability of any strategies or guidance provided and for making your own independent decisions.

Refrain from using our services to engage in any fraudulent, abusive, or harmful conduct, including but not limited to harassment of our staff or representatives.

Understand that implementation of any strategies or recommendations is undertaken at your own risk and discretion.

4. APPOINTMENT SCHEDULING AND CANCELLATIONS

Appointments for consultations or strategy sessions may be scheduled through our designated scheduling system or by contacting us directly at Sunny.Hayes@homestimulus.org.

Cancellation Policy: If you need to cancel or reschedule an appointment, you must provide at least 24 hours advance notice. Cancellations made with less than 24 hours notice may result in forfeiture of any deposits or prepaid fees, or may incur a cancellation fee as specified at the time of booking.

No-Show Policy: Failure to attend a scheduled appointment without prior notice ("no-show") may result in forfeiture of the full appointment fee and may affect your ability to schedule future appointments.

Our Cancellations: Home Stimulus reserves the right to cancel or reschedule appointments due to unforeseen circumstances, including but not limited to illness, emergencies, or scheduling conflicts. In such cases, we will make reasonable efforts to notify you as soon as possible and will work with you to reschedule at no additional charge.

Late Arrivals: If you arrive late to a scheduled appointment, the session may be shortened to accommodate other scheduled commitments, and no refund or credit will be provided for the reduced time.

5. PAYMENT TERMS

Payment for services may be required in advance or upon completion of services as specified at the time of engagement. Accepted payment methods and specific pricing will be communicated to you prior to service delivery.

All fees are quoted in United States Dollars unless otherwise specified.

Payment Timing: Unless otherwise agreed in writing, payment is due in full prior to or at the time of service delivery. For ongoing or multi-session engagements, payment terms will be specified in a separate service agreement.

Non-Payment: Failure to pay fees when due may result in suspension or termination of services. Home Stimulus reserves the right to pursue collection of unpaid fees, and you agree to be responsible for all costs of collection, including reasonable attorney fees.

Refund Policy: Due to the consultative and informational nature of our services, all sales are generally final once services have been rendered. Refund requests will be considered on a case-by-case basis at the sole discretion of Home Stimulus. Any approved refunds will be processed within 30 days of approval.

Price Changes: Home Stimulus reserves the right to modify service fees at any time. Price changes will not affect services already paid for but will apply to future bookings.

6. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Home Stimulus, its owners, employees, contractors, and representatives shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or other intangible losses resulting from:

Your use or inability to use our services.

Any reliance on information, strategies, or guidance provided by Home Stimulus.

Any financial losses or adverse outcomes resulting from real estate transactions or decisions made based on our guidance.

Errors, omissions, or inaccuracies in information provided.

Unauthorized access to or alteration of your data or communications.

Any other matter relating to our services.

In no event shall the total liability of Home Stimulus for any claims arising out of or relating to these Terms or our services exceed the total amount paid by you to Home Stimulus for services in the six months preceding the claim.

The limitations and exclusions in this section apply regardless of the theory of liability, whether based in contract, tort, negligence, strict liability, or otherwise, even if Home Stimulus has been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

7. WARRANTY DISCLAIMERS

Home Stimulus provides services on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

Our services will meet your specific requirements or expectations.

Our services will be uninterrupted, timely, secure, or error-free.

Any information, strategies, or guidance provided will be accurate, complete, current, or reliable.

Any particular results or outcomes will be achieved through use of our services.

Any incentives, credits, or savings opportunities identified will be available to you or will result in financial benefits.

Real estate market conditions, government programs, lender policies, or other external factors that may affect the applicability or effectiveness of strategies provided are subject to change without notice. Home Stimulus is not responsible for changes in such conditions that may affect the value or applicability of our guidance.

You acknowledge that real estate transactions involve inherent risks and that past performance or typical outcomes are not guarantees of future results.

No oral or written information or advice given by Home Stimulus, its employees, or representatives shall create any warranty not expressly stated in these Terms.

8. GOVERNING LAW

These Terms and any disputes arising out of or related to these Terms or the services provided by Home Stimulus shall be governed by and construed in accordance with the laws of the jurisdiction in which Home Stimulus operates, without regard to its conflict of law provisions.

Any legal action or proceeding arising out of or related to these Terms or our services shall be brought exclusively in the courts of competent jurisdiction in the location where Home Stimulus conducts business, and you consent to the personal jurisdiction of such courts.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

The failure of Home Stimulus to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

10. CHANGES TO TERMS

Home Stimulus reserves the right to modify, update, or replace these Terms at any time at our sole discretion. Changes will be effective immediately upon posting of the revised Terms.

It is your responsibility to review these Terms periodically for changes. Your continued use of our services following the posting of any changes constitutes acceptance of those changes.

If we make material changes to these Terms, we will make reasonable efforts to notify you by email (if we have your email address on file) or by posting a prominent notice through our communication channels. However, it remains your responsibility to stay informed of any updates.

If you do not agree to modified Terms, you must discontinue use of our services.

For significant service engagements or ongoing relationships, specific terms may be outlined in separate written agreements, which shall govern to the extent they conflict with these general Terms of Service.

ENTIRE AGREEMENT

These Terms, together with any additional agreements or policies incorporated by reference, constitute the entire agreement between you and Home Stimulus regarding the use of our services and supersede any prior agreements, understandings, or representations regarding the subject matter herein.

By using the services of Home Stimulus, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
